These Terms & Conditions govern your use of FoneFlex (“we”, “us”, “our”) and the purchase of any products from our website, social media platforms, or via direct sale.
By accessing our website or placing an order with us, you agree to be bound by these Terms & Conditions.

2. PRODUCTS & CONDITION
2.1 FoneFlex sells new, pre-owned, refurbished, and demo electronic devices and accessories, including but not limited to smartphones, tablets, laptops, and related technology products.
2.2 The condition of each product (new, pre-owned, refurbished, or demo) will be clearly disclosed on the product listing, invoice, or sales agreement.
2.3 Pre-owned or refurbished devices may show minor cosmetic marks or signs of wear which do not affect functionality and are not considered defects.
2.4 All devices are tested prior to sale unless explicitly stated otherwise.
3. PRICING & PAYMENTS
3.1 All prices are displayed in South African Rand (ZAR) and include VAT unless stated otherwise.
3.2 Prices, promotions, and product availability are subject to change without prior notice.
3.3 Accepted payment methods may include EFT, debit cards, credit cards, Buy Now Pay Later services, and approved payment plans.
3.4 Orders will only be processed once full payment or the required deposit has been successfully received.
4. PAYMENT PLANS & OWNERSHIP
4.1 Where products are sold on a payment plan, ownership of the device remains with FoneFlex until the full purchase price has been paid.
4.2 Failure to make scheduled payments may result in one or more of the following actions:

Late payment penalties
-
Suspension of services
-
Device restriction or blocking (where technically applicable)
-
Repossession of the device
4.3 Payment plan terms, payment schedules, penalties, and enforcement measures are governed by the applicable instalment agreement accepted at the time of sale.
4A. INSTALMENT AGREEMENT (ONLINE PURCHASES)
4A.1 Where a customer selects a payment plan or instalment option during checkout, the customer acknowledges that they are entering into a legally binding instalment agreement with FoneFlex.
4A.2 By proceeding with checkout and accepting these terms, the customer confirms that:

They have the legal capacity to enter into a credit agreement
4B. IDENTITY & CREDIT VERIFICATION
4B.1 FoneFlex may request and process the customer’s South African ID number and personal information for the purposes of:

Identity verification

Fraud prevention
-
Credit risk assessment
-
Payment enforcement where necessary
4B.2 By accepting these terms, the customer expressly consents to such processing in accordance with the Protection of Personal Information Act (POPIA).
4C. PAYMENT OBLIGATIONS
4C.1 The customer agrees to make all instalment payments on the agreed dates as communicated at checkout, invoice, or order confirmation.
4C.2 Failure to make payment on time may result in:

Late fees

Suspension of services
-
Device restriction or blocking
-
IMEI blacklisting (where applicable)

Referral to collections or legal action
4D. OWNERSHIP & RECOVERY RIGHTS
4D.1 Ownership of any device sold on a payment plan remains with FoneFlex until the full balance has been settled.
4D.2 In the event of default, FoneFlex reserves the right to:

Remotely restrict the device (where applicable)

Blacklist the device IMEI
-
Recover or repossess the device
-
Recover legal, tracing, and collection costs incurred
4E. ELECTRONIC ACCEPTANCE
4E.1 The customer agrees that acceptance of these terms via:

Website checkout
-
Tick-box agreement
-
Digital signature
-
OTP verification
shall constitute a valid and binding electronic agreement under South African law.
5. ORDER CONFIRMATION & CANCELLATIONS
5.1 An order is confirmed once payment has been received and an invoice or order confirmation has been issued.
5.2 Orders may only be cancelled prior to dispatch. Once dispatched, cancellations will be treated as a return request and handled in accordance with our Refund & Returns Policy.
5.3 We reserve the right to cancel or refuse any order due to stock unavailability, pricing errors, compliance concerns, or suspected fraudulent activity.
6. DELIVERY & RISK
6.1 Delivery timelines provided are estimates and are not guaranteed.
6.2 Shipping costs are displayed at checkout or agreed upon separately.
6.3 Optional shipping insurance may be offered at an additional cost. If shipping insurance is declined, FoneFlex shall not be held liable for loss or damage occurring during transit once the order has been dispatched.
6.4 Risk of loss passes to the customer upon dispatch where shipping insurance has not been selected.
7. LIMITATION OF LIABILITY
7.1 FoneFlex shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or services.
7.2 Our total liability, whether in contract, delict, or otherwise, shall not exceed the purchase price paid for the product concerned.
8. CONSUMER PROTECTION ACT (CPA)
8.1 Nothing in these Terms & Conditions is intended to limit or exclude any rights afforded to consumers under the South African Consumer Protection Act, 68 of 2008.
8.2 In the event of any conflict between these Terms & Conditions and the CPA, the provisions of the CPA shall prevail.
9. PRIVACY & DATA PROTECTION
9.1 We process personal information in accordance with the Protection of Personal Information Act (POPIA).
9.2 Customer information is collected solely for the purpose of processing orders, payments, deliveries, risk management, and customer communication.
9.3 We do not sell or rent customer personal information.
10. GOVERNING LAW
These Terms & Conditions are governed by and interpreted in accordance with the laws of the Republic of South Africa.
11. CHANGES TO THESE TERMS
We reserve the right to update or amend these Terms & Conditions at any time. Continued use of our website or services constitutes acceptance of the updated terms.
